Terms of Use

These terms are the agreement between you and Daisoreanu Laurentiu, the independent developer in Bucharest, Romania, who makes Moneyfesting ("we", "us"). They cover the Moneyfesting iPhone app and this website. Please read sections 11 to 13 with care: they let us end your use if you break these terms, limit our responsibility, and choose the law that applies.

1. Agreeing to these terms

You accept these terms when you continue past the app's welcome screen, where they are linked. By continuing to use Moneyfesting, you acknowledge and agree to them. If you don't agree, please don't use the app.

You also use the app under Apple's standard licence agreement for App Store apps. These terms add to it. Where the two differ, these terms apply, unless Apple's licence protects you more.

2. Who can use Moneyfesting

You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms for you. We give you a personal, non-transferable right to use the app on Apple devices you own or control, for your own non-commercial use.

3. Subscriptions, purchases and refunds

Some features need a paid subscription or a one-time purchase, which you buy from Apple through the App Store.

• Payment. Apple charges your Apple account. Prices are shown in the app and the App Store before you buy, including taxes.
• Free trial. If you start a free trial, the subscription begins automatically when the trial ends, unless you cancel at least 24 hours before.
• Renewal. Subscriptions renew automatically for the same period until you cancel. Apple charges your account within 24 hours before each period ends.
• Cancelling. You can cancel at any time in your iPhone's Settings › your name › Subscriptions. You keep access until the end of the period you paid for.
• Refunds. Apple handles payments and refunds, so we can't issue them through the App Store ourselves. You can ask Apple for a refund at reportaproblem.apple.com. If you live in the EU or UK, Apple's terms also give you 14 days from your receipt to withdraw from a purchase, including the first payment of a subscription but not renewals, on Apple's conditions.
• Price changes. We may change prices, for example because of taxes, Apple's fees, the cost of running Moneyfesting, inflation or new features. Apple tells you before a higher price applies to your subscription and, where its rules require, asks for your agreement. You can cancel before the new price applies.

When a subscription ends, the paid features lock. What you've saved in the app stays on your iPhone.

4. What Moneyfesting is and isn't

Moneyfesting helps you spend less time on apps that distract you, and shows what that time could be worth. It is a self-help tool.

• No medical or psychological advice. The app doesn't diagnose or treat anything. If your phone use or your mood worries you, talk to a doctor or a qualified professional.
• No financial advice. Money figures are estimates based on the numbers you enter. They are not a promise of income or savings, nor advice on what to do with your money.
• Blocking depends on Apple. App blocking uses Apple's Screen Time system, which we don't control. It can fail or be switched off, so don't rely on it where your safety or someone else's depends on it.
• Quotes and verses are offered for inspiration. Quotes are short extracts credited to their authors, who keep the rights in their words. Bible verses come from public-domain or licensed translations.

5. Using the app fairly

Please don't:

• copy, sell or redistribute the app or its content, or use it for commercial purposes;
• reverse-engineer or modify the app, except where the law allows it;
• try to get around payments or interfere with the app, our services or other people;
• use the app to break the law.

You are responsible for what you share from the app, such as share cards and messages.

6. Your content and feedback

Your tasks, notes, goals and own quotes stay on your iPhone and remain yours. If you send us ideas or feedback, we may use them to improve Moneyfesting without owing you anything for it.

7. Our content

The app, its design, text, art, sounds and the Moneyfesting name belong to us or to the people who licensed them to us. These terms don't give you any rights to them beyond using the app. Other brand names shown in the app, such as those of apps you can share to, belong to their owners.

8. Your data

Our Privacy Policy explains what data we handle, why, and your rights. We may use the data it describes for the purposes set out there and for any other purpose permitted by law, such as complying with a court order or defending a legal claim. We will only use data for a new purpose if it fits the purpose we collected it for or the law gives us another basis, and before we do, we will update the Privacy Policy, tell you, and ask for your consent where the law requires it. These terms don't ask for your consent to any use of your data; where we need it, we ask separately.

9. Changes to the app

We keep improving Moneyfesting, so features may change, be added or be removed: to fix problems, follow the law or Apple's rules, keep the app secure, or make it better. Changes never cost you extra. If a change makes the app worse for you in more than a minor way, we will tell you in the app at least 30 days before. You can then end your subscription within 30 days of the change and get back what you paid for the time you haven't used: ask Apple first, and if Apple doesn't refund you, write to us and we will.

10. Changes to these terms

These terms can change over time, but only for these reasons: to reflect changes to the app or its features; to follow changes in the law, a regulator's guidance or Apple's rules; to make the terms clearer or correct mistakes; or to protect the security of the app and its users. We show the date of the last change at the top of this page. For any change that isn't in your favour, we will tell you in the app at least 30 days before it takes effect. If you keep using Moneyfesting after a change takes effect, you accept the new terms. If you don't accept them, stop using the app and cancel your subscription; until your current paid period ends, the previous terms still apply to you.

11. Ending this agreement

You can stop at any time by deleting the app and cancelling your subscription. We may suspend or end your use of the app if you seriously or repeatedly break these terms. If we ever stop offering Moneyfesting, we will tell you in advance where we can.

12. Our responsibility

We work hard to keep Moneyfesting useful and reliable, but we can't promise it will always be available or free of errors. You keep all your legal rights as a consumer when the app doesn't work as described, and nothing in these terms takes them away.

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to take reasonable care. We are not responsible for loss that wasn't foreseeable, for business losses, or for problems caused by Apple's services, your device or events outside our reasonable control.

Nothing in these terms limits our liability where the law doesn't allow it, including for death or personal injury caused by our negligence, for fraud, or for harm we cause on purpose or through gross negligence.

13. Law and disputes

These terms are governed by Romanian law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. You can bring a claim in the courts where you live or in Romania, and we can only bring a claim against you in the courts where you live.

If something goes wrong, please write to us first; most problems are quicker to fix that way. You can also contact a consumer protection authority or an approved dispute resolution body in your country; in Romania, that is the National Authority for Consumer Protection (ANPC).

14. Other things

If a court finds part of these terms invalid, the rest still applies. We may transfer this agreement to someone who takes over Moneyfesting, as long as your rights stay the same.
